Title:Canvass of Results - 2022 Municipal Election

RECOMMENDATION TO COUNCIL

Staff recommends the City Council adopt Resolution No. 22-472 of the City of Roseville canvassing the votes cast at the November 8, 2022, General Municipal Election and certifying the results thereof per Placer County Official Election Results; declaring Councilmember elect for District 2, Pauline Roccucci, and Vice-Mayor-elect in District 4, Krista Bernasconi, as the two candidates receiving each the highest number of votes cast in their respective districts; and declaring Measure C, a Transient Occupancy Tax  (TOT) ballot measure, passed by a majority of “yes” votes cast during the election.  After adoption of the resolution, staff recommends that the Official Oath of Office be administered to the incoming Councilmembers for Districts 2 and 4 per the Election Code.   


 
BACKGROUND

A General Municipal Election was held on Tuesday, November 8, 2022, in accordance with law for the purpose of electing two (2) Councilmembers, one for District 2 and one for District 4, for the full term of four (4) years each, and proposing the enactment of Measure C, a Transient Occupancy Tax (TOT) ballot measure, increasing the TOT rate from 6% to 10%.  Measure C does not limit the use of the tax revenues and is therefore enacted as a general tax.

 

The Placer County Registrar of Voters Office has determined the following two candidates received the highest number of votes cast in each of their respective districts and are therefore elected to the office of City Councilmember of the City of Roseville for the full four (4) year term of office:

MEASURE C

 

The Placer County Registrar of Voters Office reports that Measure C was approved by the voters of the City of Roseville, receiving an approval rating of 72.33%, with all 53 precincts reporting. As prescribed by voter-approved City of Roseville Ordinance No. 6504 and California Elections Code, Section 9217, Ordinance 6504 shall be in full force and effect ten (10) days after the certification by the City Council of the election returns. 

 

The results for Measure C with 100% of the 53 precincts reporting as follows:

OATH OF OFFICE

 
The official oath of office for City Council candidate-elect Pauline Roccucci (District 2), and Vice-Mayor-elect Krista Bernasconi (District 4), will occur on Wednesday, December 21, 2022, at 6:00 p.m. in the Council Chambers of the Civic Center at 311 Vernon St., Roseville, CA 95678.


 
FISCAL IMPACT

There is no fiscal impact due to the election of Councilmembers because the adopted budget includes the expected costs associated with having five council members. Enactment of the Transient Occupancy Tax (TOT) rate amendment established by the passage of Measure C amending the TOT rate from 6% to 10%, is estimated to generate approximately $2.7 to $3 million of additional revenue annually.



ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378.  The canvass of election results meets the above criteria and is not subject to CEQA. No additional environmental review is required.
