RECOMMENDATION TO COUNCIL

Staff recommends that the City Council adopt a resolution authorizing the City Manager to execute an amendment to the three (3) year sole source contract purchase agreement with DataVoice International, Inc for software maintenance and support services.
 
BACKGROUND

DataVoice International, Inc has provided support services for our Outage Management Systems (OMS) and Interactive Voice Response (IVR) since 2020. DataVoice International, Inc manages multiple environments, provides backups for disaster recovery, annual updates, constant monitoring and emergency after-hours coverage for system issues. The support ensures a more stable environment for our residents and businesses and is necessary to ensure system reliability.

 
DataVoice International provided the City a maintenance agreement proposal for $455,131.63 which was approved during the September 6, 2023 City Council meeting. After the approval, DataVoice International notified the City of an error DataVoice International made with the proposal. The proposal was modified from $455,131.63 to $328,533.98. This Amendment is to replace the DataVoice International Proposal dated March 17, 2023 and approved on September 6, 2023, with the new DataVoice International Proposal dated September 21, 2023.


 
FISCAL IMPACT

The total cost of this three (3) year agreement is modified from $455,131.63 to $328,533.98 and is included in the Electric Department’s annual operations FY2023-24 budget in the City's Electric Fund. This recommendation has no impact to the General Fund.

ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378. Approval of a contract purchase agreement amendment meets the above criteria and is not subject to CEQA. No additional environmental review is required.
