RECOMMENDATION TO COUNCIL

Staff recommends the City Council adopt a resolution overruling any and all objections to the proposed abatement of weeds, rubbish, dirt and/or rank growths on property located at 1700 New Meadow Drive, Roseville, California 95747, APN 017-117-018, as well as ordering the Fire Chief to abate, or cause to be abated, the subject nuisances on said property in accordance with the law.


 
BACKGROUND

On October 18, 2023, the City Council approved Resolution No. 23-420 declaring all weeds, rubbish, dirt and/or rank growths on property located at 1700 New Meadow Drive, Roseville, California 95747, APN 017-117-018 (the “Property”), to be a public nuisance. Resolution No. 23-420 also set the date, time, and place for a public hearing to consider any objections regarding the abatement of such public nuisance and directing the Fire Chief or his designee to provide notice to the property owner of the scheduled public hearing.

 

On Friday, October 20, 2023, notice of the public hearing was mailed to the physical property address via regular mail and return receipt requested. The notice was also mailed to the mailing address for the property owner’s designated agent for service of process, which is provided on the California Secretary of State online business portal. This notice was also provided via regular mail and return receipt requested.

 

If the City Council elects to adopt the resolution overruling any objections made to the proposed abatement of weeds, rubbish, dirt and/or rank growths on Property, the City will acquire jurisdiction to abate the public nuisance and the Fire Chief, or his designee, becomes authorized to enter the Property to complete such abatement. The Fire Chief may also make an accounting of the costs of the abatement, which are then presented to the Council for confirmation. If the costs of the abatement are confirmed by the Council, the property owner will be billed for the costs. If the costs are not paid within 30 days, such costs are then submitted to the county tax collector for entry and collection on the next tax roll for the Property.

 

Alternatively, if the City Council allows the objections, assuming any are provided, and chooses not to adopt the attached resolution, then no further action is taken by the City and the Fire Chief will not abate the weeds, rubbish, dirt and/or rank growths on the Property.


 
FISCAL IMPACT

There is no fiscal impact associated with the proposed Resolution. As described above, if the City incurs costs to abate the nuisance, such costs may be charged to the property owner and constitute a special assessment and lien against the property.



ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment or is otherwise not considered a project as defined by CEQA Statute Section 21065 and CEQA State Guidelines Section 15060(c)(3) and Section 15378.  The proposed Resolution meets the above criteria and is not subject to CEQA.

 

Weed abatement performed by the City involves minor alteration in the condition of land, water, and or vegetation, and does not include removal of healthy, mature scenic trees. This activity is categorically exempt from CEQA as a Class 4 Exemption (State CEQA Guidelines Section 15304). The Exemption has been prepared and no further CEQA action is required.

 

No additional environmental review is required.
