RECOMMENDATION TO COUNCIL
Staff recommends Council adopt a resolution approving the form of two template Transit Bus Shelter Construction Fee Agreements, authorizing the City Manager to execute all pending and future Agreements, and authorizing the City Attorney to make any non-substantive changes to the form of the template Agreements.

BACKGROUND
A Transit Bus Shelter Construction Fee Agreement (CFA) is the mechanism used by the City of Roseville to satisfy transit-related conditions placed on a developer to develop certain properties within the City of Roseville. Locations of bus shelters are typically identified in specific plans and determined at the time of the planning entitlement process.
A Transit Bus Shelter CFA is used when a bus shelter is planned at a location, but there is a benefit to postpone the installation of a shelter to a later date. The two (2) versions of Transit Bus Shelter CFA forms that are used are differentiated by the need to dedicate an easement around the bus shelter pad. In the case where an easement is needed, that document is recorded.
The requested action will result in a streamlined CFA process that will save developers and City staff time during the project approval process.

FISCAL IMPACT
The current construction fee of $10,000 per shelter provides security for future installation of transit improvements with no fiscal impact to the City’s General Fund or Transportation Development Act (TDA) funds.

ENVIRONMENTAL REVIEW
The proposed project involves the construction and location of a limited number of small facilities. This activity is categorically exempt from CEQA as a Class 3 exemption (State CEQA Guidelines Section 15303). The Exemption has been prepared and no further CEQA action is required.
