RECOMMENDATION TO COUNCIL

At the June 10, 2021, Planning Commission meeting, the Planning Commission recommended the City Council take the following action:

A.      Consider the five (5) findings of fact and introduce for first reading an ordinance approving the First Amendment to the Cryil G. Barbaccia Development Agreement Relative to the Sierra Vista Specific Plan.


 
BACKGROUND

The project site is within the Sierra Vista Specific Plan (SVSP). The SVSP was adopted on May 5, 2010, and includes 2,064 acres west of Fiddyment Road and north of Baseline Road. With the adoption of the SVSP, Development Agreements with the property owners of the SVSP parcels and the City were established, which outline the development obligations within the SVSP. Consistent with the City’s General Plan, 10% of the residential units within the SVSP were designated for middle, low-, and very-low-income levels.  As described in Table 5-3: Affordable Housing Allocation of the SVSP, 20 middle-income for purchase units are allocated to Parcel CG-20. The proposed project includes a request to transfer the 20 middle-income for purchase units from Parcel CG-20 to Parcel CG-31.  These units will be transferred in the form of 10 very-low income and 10 low-income rental units.

Pursuant to Section 5.4.B of the SVSP, affordable units may be transferred between SVSP parcels subject to administrative approval by the director of the Housing Division; however, the transfer must be memorialized in a form specified by the City.  The transfer does not require a specific plan amendment if the transfer occurs between parcels located within the SVSP, and the ability to produce affordable units to meet the SVSP affordable housing goal is maintained.

As mentioned above, the project includes a request to transfer the 20 middle-income for purchase units from Parcel CG-20 to Parcel CG-31. These units will be transferred in the form of 10 very-low income and 10 low-income rental units. The proposed transfer has been reviewed and approved by the City’s Housing Division Manager. The Housing Manager requested that the transfer be memorialized by way of a Development Agreement Amendment (DAA) to maintain consistency in tracking affordable units. The proposed DAA will also allow either the development standards in the SVSP or those in the DAA to be used to develop single-family homes on Parcel CG-20.  

The Planning Commission heard the project on June 10, 2021. The proposed DAA has been analyzed as discussed on pages 2-3 of the Planning Commission staff report (Attachment 1). The proposed amendments are consistent with the requirements of the Zoning Ordinance Section 19.84.040. In addition, the language regarding Development Standards in the DAA matches other recently approved Development Agreements, including the Frederico, Westpark, and Mourier agreements.

Summary of Planning Commission Hearing

The Planning Commission heard the project on June 10, 2021. During the hearing, staff and the applicant presented the project. There were no comments or questions from the public. By a vote of 5-0 (two commissioners were absent), the Planning Commission approved the Tentative Subdivision Map; and recommended that the City Council approve the Development Agreement Amendment (Exhibit A).

Public Outreach

The proposed project was distributed to affected agencies and City departments, and all comments were considered and incorporated into the Conditions of Approval, as appropriate. Notice of the application was distributed to the Roseville Coalition of Neighborhood Associations, and public notices of the Planning Commission hearings and the City Council hearing were distributed to all property owners and residents within 300 feet of the project site.   No comments were received.


 
FISCAL IMPACT

The unit transfer will not negatively affect the City’s General Fund, and no policy conflicts have been identified. The proposed DAA consists of a transfer of the middle-income for purchase affordable housing obligation to 10 very-low income and 10 low-income rental units.  The proposed DAA will benefit the City by adding 20 affordable units that will count towards the City’s Regional Housing Needs Allocation (middle-income units do not count towards the RHNA).

ENVIRONMENTAL REVIEW

The project is statutorily exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15182, Residential Projects Pursuant to a Specific Plan, which exempts residential projects that are consistent with a Specific Plan for which an environmental document was certified, and Section 303 the City of Roseville CEQA Implementing Procedures. The Sierra Vista Specific Plan EIR (SCH# 2008032115) was certified by the City of Roseville on May 5, 2010.
