RECOMMENDATION TO COUNCIL

Request City Council appoint nine members to the Charter Review Commission.
 
BACKGROUND

The municipal government of the City of Roseville is provided through a Charter authorized by Article 11, §3(a) of the California Constitution.  The Charter is a vital document which establishes a degree of autonomy to local governments.  The Charter addresses important aspects of Roseville's authority, but in practice, it is not a static document.

 

The original Charter of the City of Roseville was adopted by the voters on April 1, 1935 and certified by the California Secretary of State on May 2, 1935.  Modifications to the original document have been approved by the voters on several occasions, with the last major amendment occurring during the 2010 General Election.  Although not required by state law, the City of Roseville has historically reviewed and amended the Charter every ten years.

 

Commission Selection and Composition

Nine members will be selected and terms of office will be from February 20, 2019 to November 3, 2020.

Commission Tasks and Staffing

The purpose of the Charter Review Commission is to review the Charter and make recommendations for amendments to the City Council for approval and submission to the voters for ratification.  The City Clerk Department and City Attorney's Office will take the lead in developing the work plan, serving as the staff liaisons, and will coordinate staff assistance to the Commission including the preparation of required materials such as agendas and minutes, as well as providing best practices and research on relevant topics. 

 

Staff will assist the Commission in soliciting input on potential Charter amendments through a variety of methods such as community meetings and soliciting direct input from other advisory boards and commissions.  The meetings will be open to the public and held pursuant to the Brown Act.

 

Tentative Timeline for Charter Review Commission

  • Organizational meeting and selection of Chair and Vice-Chair/Establish Rules of Procedures: March 18, 2019
  • Monthly meetings commencing April 15, 2019 - third Monday of every month thereafter from 5:30 - 7:30 p.m.
  • Complete report within one year of first meeting:  March 16, 2020
  • Hold two Public Forums on report and recommendations:  March 30, 2020 and April 6, 2020
  • Present report and proposed amendments to City Council:  June 3, 2020
  • Adopt resolutions calling for placement on ballot:  June 3, 2020
  • Argument and rebuttal period for measures:  August 7 to  August 17, 2020
  • Voters consider amendments at election:  November 3, 2020

 

Conclusion of Review

The Commission shall terminate and disband following the November 3, 2020 election.  


 
FISCAL IMPACT

Cost estimates for the Charter Review Commission will be approximately $5,000 for copying, supplies and materials.  Funds are included in the City Clerk and City Attorney budgets.  Indirect expenses associated with the Charter Review process include the cost of staff time to assist the Commission in conducting research and preparation of requested documents.  Indirect costs associated for staffing will be absorbed in each respective department's budget.  Cost estimates are based on the assumption the Commission will meet once a month for a twelve month period.



ECONOMIC DEVELOPMENT / JOBS CREATED

Not applicable.

ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonable foreseeable indirect physical change in the environment (CEQA Guidelines §15061(b)(3).  The appointment of members to the Charter Review Commission does not include the potential for a significant environmental effect, and therefore is not subject to CEQA.
