RECOMMENDATION TO COUNCIL
Staff recommends the City Council adopt three resolutions to approve the First Amendment to Professional Services Agreements for on-call resident engineering and inspection services with: HDR Construction Corporation; PSOMAS; and Hanna Engineering, Inc. dba The Hanna Group, and authorize the City Manager to execute them.
Staff also requests, as part of each resolution, that the City Council authorize the City Manager to execute the remaining one year extension to each Agreement without further Council approval.
| BACKGROUND
After a competitive Request for Proposal process, at their May 10, 2017 meeting, City Council approved three resolutions to enter into Profession Service Agreements with HDR Construction Corporation; PSOMAS; and Hanna Engineering, Inc. dba The Hanna Group for on-call resident engineering and inspection services for a term of three years, with the option of two additional one year extensions, and a not-to-exceed fee for each Agreement of $1.5 million over the first three-year term. These recommended first amendments extend the contract one year, to May 10, 2021 and increase the contract compensation not-to-exceed fees for each amendment by $1 million for a total not to exceed fee per contract of $2.5 million. The Agreements have been and will continue to be funded by various Capital Improvement Program project budgets.
The Public Works Engineering Division is responsible for constructing and repairing City infrastructure such as roads, bridges, drainage facilities, traffic signals, and municipal buildings. Multiple Capital Improvement Program (CIP) projects must be completed every year. Some of the recently completed CIP projects constructed utilizing the existing On-Call agreements are Woodcreek Oaks Widening, Oak Street Parking Garage, Louis Orlando Transfer Station, Sierra Gardens Transfer Point, 2019 Residential Resurfacing, and 2019 Curb Ramp and Concrete Project. These projects represent approximately $27,000,000 in construction improvements completed timely and efficiently in part due to the support of the on-call resident engineering and inspection consultant contracts.
The Engineering Division anticipates constructing multiple CIP projects this year at an estimated cost of $15 million, and anticipates the same for 2021. For these projects to be successful, cost efficient, and safe, they must be managed by a team of engineers and inspectors. Some of these projects will be managed by City staff, but additional consultant resources are necessary to supplement City staff and manage the rest due to lean staffing levels. These contract services allow staff to complete more projects without hiring additional permanent City employees. Projects requiring contract construction management that are anticipated to be constructed in 2020 include Oak Street Parking Garage Sealing Project, Arterial Roadway Resurfacing, Oak Ridge Drive Bridge Replacement, Washington Blvd Bikeway and Pedestrian Pathways Project, and the Bridge Preventative Maintenance Project. The most cost effective and time efficient method of obtaining these additional resources is through multiple on-call Professional Service Agreements.
| FISCAL IMPACT
The estimated cost for resident engineer and inspection services provided by these three Agreements for projects planned to be constructed over the next year is $3,000,000. The Agreements will be funded by various Council -pproved CIP project budgets. No General Fund resources will be used.

ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378. First Amendments to Professional Services Agreements meet the above criteria and are not subject to CEQA. No additional environmental review is required.
