RECOMMENDATION TO COUNCIL
Staff recommends that the City Council accept the Dry Creek Wastewater Treatment Plant Cogeneration and Nitrate Reduction Improvements Project as complete and authorize the Environmental Utilities Director to execute the Notice of Completion.
| BACKGROUND
On January 10, 2018, the City Council awarded a construction contract to Auburn Constructors, Incorporated for construction of the Dry Creek Wastewater Treatment Plant Cogeneration and Nitrate Reduction Improvements Project in the amount of $18,420,300.
Construction was completed for a total cost of $19,065,903. This cost includes $645,603 in change orders, approximately 3.5% of the awarded project amount. This is less than the Council approved change order authority of $2,325,019.
The Cogeneration project provides the plant the ability to convert digester gas to electricity for plant usage, which increased the treatment process energy efficiencies and reduced air emissions. The Nitrate Reduction Improvements Project included improvements that provide the ability for the plant to consistently meet the new final effluent nitrate plus nitrite limits.
| FISCAL IMPACT
The original contract amount was $18,420,300. The total change order amount was $645,603. The total contract amount of $19,065,903 was paid from the Dry Creek Wastewater Treatment Plant cogeneration and Nitrate Reduction Improvements Project budget.

ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378. The Notice of Completion meets the above criteria and is not subject to CEQA. No additional environmental review is required.
