RECOMMENDATION TO COUNCIL

Staff recommends City Council adopt a resolution authorizing the City Manager to execute Amendment 5 to Contract 96-SNR-00110 of the Funding of the Operation and Maintenance Agreement for the Central Valley Project Power Facilities between the City of Roseville and Western Area Power Administration.
 
BACKGROUND

The City of Roseville executed the Agreement for the Funding of Operation and Maintenance for the Central Valley Project Power Facilities (“Agreement”) in February 1997.  Through the Agreement, Western Area Power Administration customers provide funds for specific maintenance activities relating to Central Valley Project power plants, or the delivery of Central Valley Project energy, that would otherwise not be undertaken due to limited federal appropriations.  These activities increase the reliability of the delivery of electricity made available to Roseville under the Base Resource contract. 


The Operation and Maintenance Governance Board (“Board”) is the approving body for the Operation and Maintenance activities authorized under the Agreement.  Eligible Board members must be party to the Agreement, including Roseville. Currently, the Agreement lacks clarity on the process to fill a vacancy on the Board when there aren’t any eligible customers from a given customer group. Amendment 5 to the Agreement allows the Governance Board to appoint a customer from any group to fill the vacant position in this case.


 
FISCAL IMPACT

The amendment has no fiscal impact.

ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378.

Amendment 5 of the Funding of Operation and Maintenance Agreement for the Central Valley Project Power Facilities meets the above criteria and is not subject to CEQA. No additional environmental review is required.
