RECOMMENDATION TO COUNCIL

Staff recommends City Council adopt a resolution to approve the Reimbursement Agreement between the City and Anthem United Creekview Developments Limited Partnership in the amount of $415,683, to be paid from the Creekview Set Aside Traffic Mitigation Fund (CSATMF), and authorize the City Manager to execute the agreement on behalf of the City.


 
BACKGROUND

On October 3, 2012, City Council approved the Development Agreement (DA) for the Creekview Specific Plan.  The DA allows the developer of the Creekview Specific Plan the opportunity to receive reimbursement for City roadway improvements along Blue Oaks Boulevard and Westbrook Boulevard that are beyond the responsibility of the Developer. Funding for the City improvements is supplied through the Creekview Set Aside Traffic Mitigation Fund (CSATMF). The CSATMF is funded by developer fees and is intended to specifically fund the capital improvements associated with Creekview Specific Plan.

With this item, staff recommends City Council adopt a resolution to approve the Reimbursement Agreement between the City and Anthem United Creekview Developments Limited Partnership in the amount of $415,683, to be paid from the Creekview Set Aside Traffic Mitigation Fund (CSATMF), and authorize the City Manager to execute the agreement on behalf of the City.


 
FISCAL IMPACT

The actions requested as part of this item will have no impact to the City's General Fund. This reimbursement agreement is funded through the Creekview Set-aside Traffic Mitigation Fund, which is funded through developer-paid fees collected over time and held in the Developer Reimbursement Account.



ENVIRONMENTAL REVIEW

The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment, or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines §15060(c)(3) and §15378.

 

The reimbursement agreement meets the above criteria and is not subject to CEQA. No additional environmental review is required.
